What are the legalities associated with creating an HOA. We have a few
power controling freaks in my neighborhood who want an HOA... no way
near enough for them to be a majority. How can i instill to the rest
of the developement why we should not have an HOA and just continue to
live as we have been doing , very well just following the coventant
that we all did sign. We have no communtiy pool and there is less than
100 homes. This bunch of people definately fit into the catergory of
if i dont have it you cant. and if you are not my friend then you will
be penalized. How do you stop such idiots.

Check the laws in your state. In most states a homeowner in an existing
neighborhood cannot be forced into a newly formed HOA. CC & Rs in a
neighborhood are usually created by the developer, and purchase contracts
for such neighborhoods include a mandatory HOA clause. Also, check the
covenant that you signed to see whether a mandatory HOA could be formed.

Exposing the true cost of forming a HOA to the other homeowners should be
enough
to stop the movement.

1 You will have to incorporate as a NON-PROFIT entity.
2 You will need to hire an attorney to represent the HOA in legal manners.
3 You will need to hire a CPA to do the accounting for the HOA.
4 You will need to buy liability insurance for the HOA.
5 You will most likley have to pay membership dues to cover these costs.

Establishing a new HOA could cost as much as $50,000.00 which would
obligate the 100 homeowners to pay a one time startup cost of $500.00 per
home.
Then you might have monthly dues which are controlled by the board of
directors and
is any ammount they decide upon, could be $10.00 a month or $1000.00 a
month.
The board decides how much you pay and you have no say in the matter.

You might want to inform the homeowners of what life is like in a thypical
HOA.
